Sure, with the current state of education I am guessing the average American have no clue what Downs is – but we all know that retard look when we see it. So, the question that really needs an answer… Who the hell gives a kid with Downs a cellphone? What does he do, call his financial manager? Sell some stocks? Plan a meeting more than 5 seconds ahead of time? Ordering some more microwave pizza?

Some people seem to forget or not know that people with Down’s may not be fully in control of thier actions, but if some one attacks my kid I am not going to stop and check to see if they are retared or not before i protect my child.
I’m generally not a violent man, in fact I made tit completely through all levels of school without one single fight. However, we are talking about a small child here. Had the child been a teenager or someone of equal physical prowess I might have let him work it out with the guy. However, we see an adult sized individual KICK a small child. Now if I’m the father (or perhaps brother) and I see this behavior, I’m not going to stop and ask them to tea and crumpets to work it out. I already see a lopsided situation where a perceived adult is kicking a child.
By that action of my child being kicked by a physical adult, my inner spiderman will kick in. I WILL strike that adult back in a manner whereas he cannot strike my child again. Even people with Downs syndrome will eventually learn that bad behavior brings bad consequences. I hope that mother/care taker uses the event to constantly remind that person, when he wants to kick, “what happened last time” and that a kick to a child = punch in the face.
If he’s got the brains to use a telephone, then he’s got the brains to know not to kick people, especially small children.
There are certain things people will with mental disabilities off the hook for. None of them is kicking a child. If he has problems kicking, then maybe he should not be out in public.
The only thing that child did was be excited for being in a fast food restaurant. What did he get for it? Being kicked in the balls by a person that should have been better supervised.
The only difference iff he knew that that guy had downs would be: he should’ve punched the lady who was his caretaker.
On legal terms: I’m not to firm with US law, but from where I come from, either the woman who is his guardian should be prosecuted for battery *or* the downs guy should not be allowed in public anymore (confirm with societies rules or stop being a part of it). People tend to overprotect disabled people a lot. I’ve had to do a lot with a person with downs syndrome (several times per week for over a year) when I was younger and they do learn. Just slower. And they can be raised to a society-conform behaviour. Honestly – if he get’s punched in the face every time he kicks someone, he will stop. Fast. Assault on a child is not excusable.

The man with down’s syndrome kicked the child because he lacked the adult social understanding to know that it was not ok to do that. While the reaction of the man who punched him was obviously inappropriate, he was acting on adrenaline and instinct in the second after a threat to his child was perceived. From the looks of it, the kid’s dad/brother/whatever didn’t have time to take a really close look at the disabled man before leaping into action to protect his child. Anyway, his reaction was wrong in retrospect but understandable in context, and I don’t think anyone here should be judging so much.

If you use the provided link to the longer video there are some facts that become evident that haven’t been mentioned.
The man with Down’s seems adept at handling the cell phone. Down’s is not “all or nothing” and there are varying degrees of ability involved. His reaction to the entrance of the child is totally inappropriate. He is definitely in the care of the lady at the checkout.
The whale with the Down’s can’t even wait to get her whole order, (hanging around the register for some reason) before she starts stuffing her neck. Seems to be more dredging needed in that gene pool or some disciplinary action if she is a caretaker. Her attention was not where it should have been and her reaction was delayed and ineffective even when she did finally pull her face from the fries. Mother or caretaker makes no difference; she is not qualified to handle the Down’s in public.
The video seems chopped here. The full video shows a very fluid movement on the part of the black father/ big brother. The child entered first and the black guy moved on the Down’s in a straight line without stopping. His action was obviously to protect the child from further assault. Once the Down’s was incapacitated he didn’t strike him again, but stood over him to prevent him from getting up. The whale very dispassionately pushed at him with her flipper, justifying the thought of her being a handler instead of a parent. Had she been a parent one would think that her reaction would have been similar to that of the black guy and that would have added to the funny factor as well.
Overthinking seems to the order of the day here. The Down’s probably won’t kick “anybody” for a while. One hopes he wasn’t seriously injured, but that is part of being “in the world” and acting out. Hopefully the mother/handler will be more aware in the future and examines her priorities in the presence of food. The video would clear the black guy of any liability in any reasonable court.

As well, when he is facing the camera, the guy doesn’t look totally like a person with Down’s. I have two cousins who have Down’s syndrome and you can tell from far away. Their mother, who has a mild case, can get away with looking like you and me on any day.

The downs person didn’t even hit the kid with the kick. He kicks past the kid. Watch closely. It was not a huge kick but it was substantial enough to have some effect on the child yet there is not even a tremor from him. The punch dude was right behind the boy so he should have seen this too.
